This Court is approached under Section 482 Cr.P.C. with a prayer soliciting a direction to ensure expeditious disposal of a pending NDPS case of learned Additional District Judge, Barasat(Special Court under NDPS Act) vide case No.250 of 2019.

The learned Advocate for the petitioner submits that though the petitioner is in custody since 8.11.2019, for the alleged recovery of contraband, above the commercial quantity, but there has been no commencement of the trial as yet framing charge so as to prevent protraction of the trial.

Mr. Hossain, learned Advocate representing the State submits that the next date has already been fixed on 5th March, 2021 for consideration of the charge. When date has already been fixed by the learned court below for consideration of the charge, the court is of the view that the instant revisional application may be disposed of, so as to sub-serve the purpose of justice, as proposed to be obtained by giving direction mentioned as hereinbelow.

Learned court below is directed to make effective utilization of the date so far fixed for consideration of the charge, and if for any reason whatsoever the date so fixed goes unutilised, the same may be fixed three weeks after peremptorily and frame charge accordingly, taking support and co-operation of the learned Public Prosecutor, and proceed thereafter with the trial aiming at expeditious disposal, without granting unnecessary adjournment, unless it is unavoidable.

With this direction and observation, the revisional application stands disposed of.
