Bhadra ... ... for the petitioner Mr. Sandip Chakraborty Mr. Sandip Kundu ... ... for the State Learned advocate appearing for the petitioner submits that the petitioner was arrested on 12th March, 2025 and is in custody for more than 11 months. Till date prosecution could not substantially progress in the case and so far as the materials, which are available, the same do not inspire confidence so far as the complicity of the petitioner is concerned.

Learned advocate appearing for the State has produced the case diary drawing attention of this Court to the statements of some of the witnesses.

The case involves recovering of dead body from a trolley bag which was carried in a taxi and the circumstance under which the evidence was detected do raise reasonable

suspicion. It is also pointed out that the statements of 7 witnesses out of 18 witnesses have been examined. Having considered that some of the witnesses who have expressed in their statements regarding the complicity of the petitioner and the witnesses who are to be examined at this stage, considering the gravity of the offence, I am not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner in CRM (M) 261 of 2026 is dismissed.
