Criminal Revisional Jurisdiction 07-02-2024 Subha Item no. 21 Ct no.34 CRR 359 of 2024 Sri Shubhajit Roy -versus- The State of West Bengal Mr. Md. Ashraf Ali Mr. Indrajit Chatterjee ....for the petitioners.

Petitioner is aggrieved by the continuation of Narendrapur Police Station Case no. 402 of 2019 dated 21-03-2019. In the said proceedings the Investigating Agency on conclusion of investigation submitted chargesheet under the relevant provisions of the IPC in relation to Fisheries Act and West Bengal Land Reforms Act. Learned advocate for the petitioner submits that the petitioner is a doctor and he has been implicated in the instant case and unknowingly is compelled to face the criminal trial. Records of this revisional application reflect that the chargesheet was submitted on 16th December, 2022, but till date the documents under Section 207 of the Code of Criminal Procedure has not been handed over to the present petitioner.

Petitioner would be at liberty to canvass the issues in the present revisional application before the learned trial court at the stage of consideration of charges and at the subsequent stages. Learned Magistrate in seisin of the mater would take steps so that the documents under Section 207 of the Code of Criminal Procedure is supplied on the next date or within a month thereafter.

With the aforesaid observations, the revisional application being 359 of 2024 is disposed of.
