Md. Shah Minhajuddin, Md. Mohiuddin, Ms. Neelam Akhtayar ... For the Respondent Nos.8, 9 & 12. The petitioner approached this Court being aggrieved by the inaction of the police authorities. Earlier the writ petition was heard and State was directed to submit report to ascertain regarding the accusations as to whether the complaint in respect of some of the individuals accusing to be foreign nationals have been ascertained or not.

Mr. Samanta, learned advocate appearing for the State today has submitted reports of both Maheshtala Police Station and Bishnupur Police Station. Let the same be kept with the record. So far as the accusations regarding the nationality is concerned, the Inspector-in-Charge, Bishnupur Police Station submitted a report which reflects that on ascertainment of facts, the allegations against some of the respondents to be Bangladesh nationals are not substantiated. So far

as the arms licences are concerned, the same have also been verified by the police authorities. Having considered the same so far as the feud between the petitioner and the private respondents are concerned, a proceeding under Section 126 of BNSS has been drawn up. If the petitioner is aggrieved by the action taken by the police authorities, the petitioner would be at liberty to approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess as to whether cognizable offences are made out, ascertain as to whether a case for investigation is made out and thereafter pass necessary orders.

Police authorities would also oversee and keep surveillance so that no untoward incident results as the petitioner and the private respondents seem to be in a strained relationship. With the aforesaid observations, the writ petition being WPA 2042 of 2025 is disposed of. A copy of the report dated 31.01.2025 be handed over to learned advocate appearing for the petitioner.

There will be no order as to costs.
