Biswajit Sarkar versus Union of India & Anr.

Mr. Moyukh Mukherjee, Ms. Sagnika Banerjee, Mr. Samrat Mondal ... For the Petitioner.

Mr. Amajit De, Spl. P.P.

... For the C.B.I.

Learned advocate appearing for the petitioner submits that during the pendency of the present writ petition, the CBI has submitted supplementary charge-sheet dated 30th June, 2025. Learned advocate submits that having considered the name of the accused persons in the supplementary charge-sheet, prima facie, the grievance of the petitioner which was canvassed in the writ petition, has been addressed.

In the changed circumstances, petitioner only restricts his prayer that the petitioner may be afforded protection in view of the persons who have been presently been charged with the offence. Be that as it may, the petitioner would be at liberty to take out application under the Witness Protection Scheme, 2018 before the jurisdictional court.

The jurisdictional court would assess regarding the threat perception of the present petitioner and accordingly pass necessary directions under the said Scheme.

With the aforesaid observations, the writ petition being WPA 2316 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
