Hara Mohan Meheta @ Dulal v. State Of West Bengal
06/03/2026 D/L - 20 Court No.28 S. Kundu Allowed C.R.M.(A) 323 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Purulia (M) P.S case no. 393 of 2025 dated 16/12/2025 under sections 338/318(4)/85/89/351(3) of the BNS.
In the matter of: Hara Mohan Meheta @ Dulal
...Petitioner.
Mr. Sourav Chatterjee Mr. Sougata Mitra Mr. Nikhil Kr. Gupta Ms. Soma Chakraborty Mr. Subhadeep Maitra ...for the petitioner.
Mr. Anupam Das Adhikary Mr. Bikram Mitra ...for the State.
1. Learned senior counsel appearing on behalf of the petitioner submits as follows. It is alleged in the FIR that the petitioner and the victim were in a relationship since 2008. Even as regards the abortion no date or time has been given in the FIR. After all these, when the relationship between the two turned sour, an FIR was lodged in 2025.
2. Learned counsel appearing for the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statement of the victim and copy of the marriage certificate produced by the de-facto complainant, some photographs and medical reports regarding the termination of pregnancy in the year 2021. The victim happens to be a Nurse in a hospital. It is also
alleged that the victim had deceived her to believe that he was not married. The petitioner gave a different identity of his.
3. Such allegations are denied and disputed by the petitioner.
4. Considering the fact that the FIR was lodged in the year 2025 with an allegation about termination of pregnancy in the year 2021 and the fact that two were in some kind of a relationship since 2008, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.
5. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the Investigating Officer once a week till submission of report in final form.
6. Accordingly, the application for anticipatory bail is allowed.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
