The petitioner alleges that the respondent no.5 was granted a connection to his submersible pump which is situated within 200 metres from the petitioner's land. The petitioner relies on different circulars of the Water Resources Investigation & Development Department, Government of West Bengal in support of his contention that the submersible pump was within the semi-critical zone. The same could not be allowed to be installed within 200 metres radius. Safe distance was required to be maintained.

Learned Advocate for the West Bengal State Electricity Distribution Company submits that the concerned submersible pump is within the Sagardighi Block and Sagardighi Block does not fall within the semi-critical zone. Earlier, Sagardighi used to be within the semi-critical zone but recently Sagardighi has been identified as a safe zone. Be that as it may, as a complaint has been raised by the petitioner, the writ petition is disposed of with a direction upon the Station Manager, Sagardighi Customer Care Centre to treat the writ petition as a representation and dispose of the same upon hearing the writ petitioner and the respondent no.5. A reasoned order shall be passed and communicated to the parties within a period of three months from the date of communication of this order.

All parties are to act on the basis of server copy of this order.
