Abdur Rakib Mr. Md. Mojahid Mehedi ...for respondent nos.9 & 10 The petitioners allege that respondent nos. 9 and 10 have undertaken unauthorised construction over L.R. Plot No. 4429, Mouza - Mamudpur, under Khatian No. 32, Police Station - Shibdaspur, District - North 24 Parganas.

The petitioners claim to be the owners of the aforesaid land and contend that respondent nos. 9 and 10, without obtaining any permission from the concerned Panchayat authority, have undertaken construction encroaching upon their property. Learned advocate appearing for respondent nos. 9 and 10 denies the allegation of encroachment. It is submitted that the petitioners had earlier filed a title suit concerning the self-same dispute, which was dismissed for default.

This Court, however, is not concerned with the title dispute between the parties.

I grant liberty to the petitioners as well as to respondent nos.

and to make fresh representations before the concerned Panchayat for ventilation of their respective grievances. If such representations are made, the same shall be considered by the Pradhan in accordance with law after giving due opportunity of hearing to all concerned.

Accordingly, WPA of stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
