For the State The learned advocate for the petitioners submits that out of political rivalry the petitioners have been implicated in the instant case and the names of the petitioners were revealed during the interrogation of the co-accused persons. The learned advocate for the State opposes the prayer for anticipatory bail and draws the attention of this Court to the relevant statements of the co-accused persons, which are inadmissible in evidence.

Having regard to the fact that the charge sheet has already been submitted we do not find any reason for custodial interrogation of the petitioners.

Accordingly, we allow the application for anticipatory bail and direct that in the event of arrest, the petitioners, namely, Ramchandra Sing alias Ram Chandra Singha and Tapas Marik shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten thousand only each), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the

conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioners shall meet with the Investigating Officer of Amta Police station once in two weeks.

Accordingly, the application for anticipatory bail being CRM 853 of 2021 is thus disposed of.
