The respondent/the New India Assurance Company Limited is represented by the learned counsel. 2.
No one is present on behalf of the appellant. 3.
It appears from the earlier order passed by the Court that a direction was given upon the respondent/Insurance Company to serve notice upon the learned counsel who appeared before the Trial Court on behalf of the appellant.

It is submitted by the learned counsel appearing on behalf of the Insurance Company that despite best efforts it could not be possible to contact with the learned advocate who appeared on behalf of the appellant before the Trial Court. It further appears that as per direction passed by this Court administrative notice was also issued to the appellant.

I find that the present appellant has lost interest to proceed further with the present appeal and
as such there is no option but to dismiss the present appeal.

Accordingly, the appeal being no. FMA No. 536 of 2015 along with the connected applications, if any, stands dismissed for default but without any order as to costs.

Interim order, if any, stands vacated.
