...for the respondent During the pendency of the appeal, good sense has prevailed and the parties have agreed to settled their dispute by entering into a Terms of Compromise.
The compromise petition annexing the Solenama (Terms of Compromise) dated 20th September, 2022 duly signed by the parties in according with Order XXIII Rule 3 of the Code of Civil Procedure has been filed. The terms are lawful. In view thereof, the appeal and the application are disposed of on the basis of the Solenama (Terms of Compromise). The original Solenama is filed separately and taken on record. The department is directed to draw up the decree on the basis of the Solenama dated 20th September, 2022 annexed to the petition.
The department is directed to draw up the decree as expeditiously as possible and thereafter, send down the record along with the copy the appellate decree to the learned Trial Court.
In any event, the entire process should be completed on or before 23rd December, 2022.
This order shall be immediately communicated to the department for compliance.
FA 172 of 2016 and CAN 2 of 2022 are accordingly, disposed of.
