The present case was initiated being registered as Taherpur P.S. Case No. 75 of 2022 dated 02.03.2022 under sections 447/448/354/325/506/34 of the IPC.
The report which has been submitted on behalf of the State encloses the statement of one Mithu Ghosh as well as a communication made to the officer in charge of Taherpur P.S.
The contents of the said report reflects that the defacto-complainant is not interested to pursue with the case being Taherpur P.S. Case No. 75 of 2022 dt. 2.3.2022 as there has been an amicable settlement between the parties.
As some of the offences are not only noncompoundable but the same have some effect in the society and having regard to the nature of the case and the fact that after charge-sheet being submitted, the defacto-complainant is not interested to pursue with the case, for the ends of justice, I am not inclined to stretch the case any further as the chances of conviction are bleak.
Accordingly, all further proceedings of Taherpur P.S. Case No. 75 of 2022 dated 2.3.2022 under sections 447/448/354/325/506/34 of the IPC including the chargesheet submitted before the ld. Jurisdictional court being ACJM, Ranaghat, Nadia, is hereby quashed.
With the aforesaid observations, CRR 349 of 2024 is allowed.
Pending application, if any, is also disposed of. Report so submitted be kept with the record.
