2. The respondent/CBI is represented.

3. In pursuance of the direction passed by this Court a report is submitted by the department indicating that during pendency of appeal the sole appellant/convict was expired on 14.01.2004.

4. The photocopy of certificate of death filed with this report also affirms the death of the said appellant/convict Durgadas Mukherjee.

5. As the sole appellant/convict has been expired during pendency of this appeal, the instant appeal stands abated against him.

6. Accordingly, the instant appeal being CRA 17 of 2000 is hereby dismissed as abated.

7. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.

8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
