This intra-Court appeal filed by the writ petitioner is directed against the order dated 9th January, 2024 passed in WPA 20481 of 2023. The said writ petition was dismissed on the ground that Union of India has not been impleaded as a party since the writ petitioner has challenged the constitutional validity of the "Maintenance and Welfare of Parents and Senior Citizens Act, 2007". The writ petitioner in the writ petiton though impleaded the Legal Advisor, Ministry of Law and Justice, Government of India but the appropriate authority of the Government of India has not been impleaded.

Therefore, we grant permission to the appellant to withdraw the writ petition and file a fresh writ petition impleading the appropriate and necessary authority of the Union of India.

In view of the above, the appeal stands dismissed. Consequently the writ petition stands dismissed as withdrawn with the aforementioned liberty.
