Mr. Amal Kumar Saha Mr. Irish Paul ..for the Petitioner Mr. Lalit Mohan Mahata Mr. Prasanta Behari Mahata ....for the State Report submitted by the State is taken on record. The petitioner initially lodged complaint before the police authority against the private respondents on August 05, 2021. Since the complaint was not acted upon by the police, the petitioner took necessary steps under Section 156(3) of the Code of Criminal Procedure and pursuant to a direction of the learned Magistrate, the FIR was registered. The petitioner alleged that there was no further progress in investigation of the case for which he again lodged a complaint before the police on September 22, 2022 seeking direction for proper investigation of the case. Learned counsel for the State submits that charge sheet has been submitted upon completion of investigation.

In view of the above, this Court is inclined to hold that in event the petitioner is aggrieved by the charge sheet or mode and manner of investigation, he is at liberty to

approach the jurisdictional Magistrate for redressal of his grievance.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
