The writ petition was preferred as the petitioner is 15.07.2025 Court No. 35 M/L. No.767 Rakib aggrieved in spite of the progress of Sankrail Police Station 1137/2020. According to the petitioner the investigation of the said case was not concluded. As none appears on behalf of the State, Ms.

Neelam Singh, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. Her appearance may be regularized by the concerned authorities.

Since more than four and half years have passed it is presumed that Sankrail Police Station case no. 1137/2020 dated 30.11.2020 has already concluded in submission of a report under Section 173 of the Cr.P.C. In case any report has not been submitted by the police authorities regarding conclusion of the investigation, learned Magistrate in seisin of the said criminal case would pass necessary directions to ensure that within a period of 30 days the investigation is concluded. The Inspector-in-Charge/Officer-in-Charge, Sankrail Police Station would accordingly send a report to the learned Magistrate.

Since the writ petition was also filed after about three and half years at this stage, I am of the view that it would be not possible for this Court to interfere and leave it to the discretion of the learned Jurisdictional Magistrate to take appropriate steps in accordance with law.

With the aforesaid observations WPA 1855 of 2024 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
