Learned counsel appearing on behalf of the petitioner submits that the petitioner was not aware that such an FIR was lodged against him in 2012. He was also not aware about submission of charge sheet. He came to know about the pendency of this case only after the proclamation was issued.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail.

Considering the fact that the petitioner has remained absconding since 2012, a proclamation has been issued against him and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
