In Paragraph 5 of the said declaration in the Affidavit, the petitioners have stated that in the interest of administration of justice, they have accepted the proposal/scheme, which has been offered by the State/the Learned Advocate General and have consented to abide by the same.

In view of the changed circumstances, I am of the opinion that further continuation of the instant proceedings are not warranted.

Accordingly, further continuation of Beliaghata P.S. Case No. 8 of 2023 dated 6.1.2023 alleging commission of

offence punishable under Sections 120B/153A/295A/420/468/504/505(1)(b)/505(2) of the IPC and Section 66D of the Information Technology, which was under the supervision of the Learned ACJM, Sealdah, pursuant to a case being registered corresponding to G.R. Case No. 588 of 2023, is unwarranted and the same, as such, is liable to be quashed.

Needless to state that the proceedings are quashed so far as the present petitioners before this Court are concerned namely, T.V. Today Network Limited and Indrajit Kundu, Deputy Editor and In-charge of Kolkata Bureau of the T.V. Today Network Ltd.

The State has proposed that the outcome of the present revisional application be restricted to the present proceedings and should not be treated as a precedent in other cases.

Such contentions advanced by the State, is accepted. In other cases independent steps would be taken and considered accordingly as the situation so arise. With the above observations, CRR 265 of 2023 is allowed.

Pending application, if any, is also disposed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance, with all requisite formalities.
