In Re: An Application under Section 482 read with Sections 397/401 of the Code of Criminal Procedure.
The present revisional application has been preferred challenging the proceedings relating to M.P. Case No. 439/2011 which was preferred before the learned SubDivisional Executive Magistrate, Asansol, Burdwan. Records reflect that the said case was preferred under Sections 144/107/116(1a) of the Code of Criminal Procedure and at the stage of admission of the revisional application, a co-ordinate Bench of this Court on 30.01.2012 was pleased to stay the proceedings for a limited period of time. Having regard to the nature of the contentions, which is appearing in the record, the same reflects that the disputes and differences are private and personal in nature and are to be dealt with by appropriate civil court.
In view of the nature of jurisdiction, which is expected to be exercised by the Executive Magistrate, I am of the view that with passage of time, the whole application has become infructuous. As such, no interference is called for. Accordingly, the revisional application being CRR 150 of 2012 is dismissed.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
