Md Wasim v. State Of West Bengal & ORS
27.07.2021 Item no.2 Ct. No.34 CHC C.R.R. No.151 of 2012 (Via Video Conference) In Re: An application under Sections 397, 401 read with Section 482 of the Code of Criminal Procedure.
AND In the matter of:- Md. Wasim ... petitioner Mr. Anil Kumar Chattopadhyay ...for the petitioner The order dated 16.12.2011 passed by the learned Executive Magistrate, 2nd Court, Alipore, South 24 Parganas, was the subject-matter of challenge before this Court. The application which was filed before the learned Executive Magistrate was under Section 144(2) of the Code of Criminal Procedure and by the impugned order the proceeding was dropped for non prosecution. Almost nine years have passed in the meantime and the nature of the proceeding under Section 144(2) of the Cr.P.C. relates to urgency of cases. As the main application has become infructuous, consequently, the present revisional application has also become infructuous with passage of time. Thus, no interference is called for. Consequently, C.R.R.151 of 2012 is dismissed as infructuous.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
