Learned advocate appearing for the petitioners submits that petitioners are in custody for eight months for alleged recovery of 44 bottles of phensedyl from the petitioner no.1 and 95 bottles of phensedyl from the petitioner no.2.

Learned advocate appearing for the State submits that the case presently is at the stage of consideration of charges. However, the court is unable to proceed because one of the accused person absconding.

In view of the aforesaid, I direct the learned Trial Court to exhaust the process of law and if required, split up the trial within a period of sixty days from the next date so fixed. Learned Trial Court, after consideration of charges is over, would release the petitioners on bail on such terms and

conditions as it deems fit and proper for ensuring further appearance of the petitioners before the court during the trial.

With the aforesaid observations, the application for bail, being CRM (NDPS) 195 of 2026, is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
