Petitioner being aggrieved by the inaction of 05.02.2025 Court No. 35 Item No.72 Rakib the police authorities approached this Court. State has submitted a report. Report reflects that there is a dispute between the petitioner and the respondent no.9. The report reflects that there were monetary transactions existing between the parties and subsequently a title suit being Title Suit no.157 of 2022 has been initiated against the present petitioner. Learned advocate for the private respondent submits that it was private respondent no.9 who has initiated the Civil Suit for recovery of the dues. I find from the report of the police authorities that there were some excesses and law and order being taken in their own hands. To that effect police

authorities have registered Arambagh PS case no.30/2025 dated 18.01.2025 under the relevant provisions of BNS, 2023. The investigation of the said case is under progress.

Having regard to the fact that there is a dispute and difference existing between the petitioner and the private respondent, I direct the police authorities to keep a strict vigil and to ensure that no breach of the peace and/or tranquility and/or any untoward incident result because of the strained relationship existing between the petitioner and the respondent no.9.

Needless to state that this Court has not entered into the merits of the case, so far as the transactions are concerned and it would be for the Civil Court to decide the same.

With the aforesaid observations WPA 2025 of 2025 is disposed of.

Report submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
