C.O. 150 of 2021 Smt Maya Chatterjee & Ors Vs Smt. Ratna Paul & Anr Mr. Sourav Banerjee, Mr. Arnab Dutt, For the Petitioners.

The grievance of the petitioner is that application under Order 8 Rule 1 of the Code of Civil Procedure filed in connection with Title Suit No. 1275 of 2019 has been kept pending for a long period. It further appears that applications under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997 have also not been disposed of by the learned Trial Court for a long period of time.

In view of present pandemic situation prevailing all over the country, such delay cannot be wholly attributed to the Trial Court.

However, for the interest of justice this revisional application is disposed of with a direction upon the learned Trial Judge to make all endeavour to dispose of the application under Order 8 Rule 1 of the Code of Civil Procedure as well as the applications under Sections 7 (1) and 7 (2) of the West Bengal Premises Tenancy Act, 1997 within a period of three months from the date of the communication of this order.

The revisional application C.O. 150 of 2021 is disposed of.

There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the parties on usual undertakings. ( Kausik Chanda, J.)
