On instruction it is submitted by the learned counsel appearing on behalf of the appellant that presently the appellant does not intent to proceed further with this case.

It is further said by the learned Advocate of this appellants that a case under Section 166 of the Motor Vehicles Act was filed and the same was allowed by awarding compensation in favour of the claimants and as such this appeal becomes infructuous.

In view of the aforesaid submission the instant appeal is hereby dismissed as infructuous.

Consequently the applications if any filed in connection with the case are also dismissed.
