Affidavit-of-service filed on behalf of the petitioner is taken on record.
By the present writ petition, the petitioner seeks for release of the outstanding amount to the tune of Rs.8,40,224/- (Rupees Eight Lakhs Forty Thousand Two Hundred and Twenty Four only) in respect of the work executed under NIT No.52/NREGA/KGP/21-22 dated 07.03.2022.
The petitioner contends that it has executed the work allotted to it under the NIT. The outstanding amount is Rs. Rs.8,40,224/- (Rupees Eight Lakhs Forty Thousand Two Hundred and Twenty Four only) in respect of three works executed by the petitioner. Though Advocate's letter was sent to respondent no.2, Block Development Officer and Programme Officer (MGNREGS) on 4th December, 2023, yet the outstanding
amount has not been disbursed. Hence, this writ petition.
Learned Advocate for the petitioner seeks specific direction upon the respondent authority for disbursement of the amount of Rs.8,40,224/- (Rupees Eight Lakhs Forty Thousand Two Hundred and Twenty Four only) in favour of the petitioner.
Mr.
Tanweer J Mondal, learned Advocate representing the State files a report dated 13th November, 2024 furnished by the Block Development Officer, Chanchal-II Development Block, Malda. He submits that due to MNREGA online portal being locked by the Government, the bills could not be entered into MNREGA portal and due to such technical problem, the respondent authorities were unable to disburse payment in favour of the petitioner.
Upon going through the report, it is found that there is no such dispute as regards completion of the work allotted to the petitioner and the outstanding amount of Rs.8,40,224/- as claimed by the petitioner. Accordingly, respondent no.2, Block Development Officer and Programme Officer (MGNREGS), Chanchal-II Development Block is directed to take immediate steps for disbursement of the amount of Rs.8,40,224/- (Rupees Eight Lakhs Forty Thousand Two Hundred and Twenty Four only) in favour of the petitioner within a
period of six weeks from date of communication of this order.
Learned advocate for the petitioner is directed to communicate this order to respondent no.2, Block Development Officer and Programme Officer (MGNREGS), Chanchal-II Development Block.
With the above observation, the writ petition being WPA 1891 of 2024 stands disposed of.
All connected applications, if any, stand disposed of.
There will be, however, no order as to costs. Interim order, if any, stands vacated.
All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
