During the course of submissions, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file an application for recalling of the warrant in term of Section 70 sub-section (2) of the Cr.P.C. (Section 72 subsection (2) of the BNSS). 2.

Liberty granted.

Let the petitioner move an application for recalling of warrant of arrest issued against him. Learned trial court shall decide the same in accordance with the law expeditiously without being influenced by the proceedings before this Court. 4.

All the contentions are left open. It is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case.
