AGP Mr. Raja Ram Banerjee ... for the State-respondent(s) The petitioners are aggrieved by the fact that in spite of the information being furnished with the concerned police station regarding their water-body being damaged as also free access to their property being obstructed, the police authorities have not taken any step in accordance with law.

Learned advocate submits that in spite of the registration of the FIR, no action has been taken by the police authorities for progressing with the investigation of the said case.

Mr.

Ganguly, learned AGP, appears on behalf of the State and

submits that on the basis of the information furnished by the petitioners Debra P.S. Case No. 358 of 2020 was registered for investigation and the investigating agency on conclusion of investigation submitted charge-sheet on or about 14th August, 2021.

Again, another case was registered on the basis of a complaint of the petitioner no.1, namely, Samarjit Samanta.

The same being Debra P.S. Case No.

834 of 2024 dated 29.12.2024 and the investigating agency on conclusion of investigation submitted charge-sheet on or about 27.1.2025.

In view of the police authorities taking steps in respect of the information furnished by the petitioners, so far as the action of the police authorities are concerned, if the petitioners are aggrieved, they would be at liberty to take appropriate steps before the jurisdictional Court since charge-sheet has already been

submitted in connection with the said case(s).

However, there are also cases against the petitioners which have been initiated at the behest of the respondents which are being investigated by the police authorities.

Having considered the fact that both the parties are at loggerheads, the police authorities would keep a strict vigil and ensure that no breach of peace and tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 2090 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioners.
