1. The parties are not represented nor any accommodation is prayed for on their behalf.
2. The appeal is pending since 2001. The appeal was appearing in the warning list of cases on and from 31st July, 2023 with a clear indication that the said matter shall be transferred to the main list on 3rd August, 2023 before this Bench. In spite of adequate notice, the appellant is not represented.
3. There is a delay of 720 days in preferring the appeal. No application for condonation of delay has been filed. We have noted various defects indicated by the Additional Stamp Reporter in its report dated 08.04.2008. The appellant has practically shown no interest to proceed with the appeal.
4. In view of the fact the appeal was filed out of time and till date no attempt has been made to file any application for condonation of delay, the appeal is dismissed as time barred.
5. This order shall be immediately communicated to the Court of learned Land Acquisition Judge, 1st Court at Jalpaiguri by the learned Registrar Administration (L&OM) for information and disbursement of the compensation amount as determined by the learned LA Judge in Misc. Judicial case no. 22/94 analogously with Misc. Judicial Case Nos. 19/94, 18/94, 21/94 and 23/94.
6. The department is directed to communicate this order to the
award holder by speed post with acknowledgment due.
7. The learned Registrar Administration (L&OM) is requested to ensure compliance of this order.
