Galib Mr. Subhra Nag ... for the State The petitioner is aggrieved that the Haripal Police Station is not taking any steps with regard to repeated complaint against the private respondents. It is submitted that the private respondents are preventing the petitioner from cultivating and are stealing away produce. Counsel for the private respondent submits that they have been filling the land for substantial period of time. Admittedly, the petitioner had inherited the land along with his brother. In some of the complaints annexed with the petition, the petitioner has also complained against his brother.

This Court is of the view that the matter is purely civil in nature and the parties may have their respective title in respect of the property adjudicated before a civil or other statutory forum.

The Officer-in-Charge, Haripal Police Station shall, however, maintain strict vigil over the property and ensure that there shall be no breach of peace. With the aforesaid observations, the writ petition is disposed of.
