Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. None appears for the Panchayat and the private respondent despite service.

The petitioner alleges that the private respondent has raised illegal construction in the land owned and occupied by him. Several requests made before the Panchayat for demolishing such construction have fallen on deaf ears. It appears from the report submitted by the State that the private respondent has stated that he is not the owner of the land in question which belongs to his uncles who have allowed him to reside therein. He has also claimed that the said land does not form part of the land owned by the petitioner.

It appears that representation has been submitted by the petitioner in this regard before the Panchayat on 29th December, 2025.

The petitioner alleges that the representation is yet to be considered.

In view of the above, this Court directs the Pradhan, Jangalia Gram Panchayat, being the 6th respondent herein, to consider and dispose of the representation submitted by the petitioner within two weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The 6th respondent shall communicate the decision taken by him to the parties within seven days thereafter. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
