It is submitted that the petitioner is languishing in jail for about 211 days in connection with the aforementioned case allegedly on the ground that the contraband of commercial quantity was recovered from the exclusive possession of the petitioner.

In view of the fact that provision under Section 37 of the NDPS Act is attracted in this case, we do not think that this is a fit where the petitioner may be enlarged on bail.

However, our attention is drawn to the fact that chargesheet has already been submitted and the next date for framing of charge is fixed on 22nd April, 2021. Though we reject the bail prayer of the petitioner, but we request the learned Judge to take up the said matter on the said date and thereafter efforts shall be shown to expedite the hearing of the said case.

With the aforesaid observations, the application for bail being CRM 879 of 2021, is, accordingly, disposed of. (Harish Tandon, J.) (Tirthankar Ghosh, J.)
