The grievance of the petitioner is that Panihati Municipality has only affected part demolition of the unauthorised construction but is yet to demolish the entire unauthorised construction.
It has been submitted that on 8th September, 2021 the private respondent was intimated by the municipality to demolish the illegal construction. As the private respondent did not take steps to self demolish the illegal construction, accordingly, municipality demolished a portion of the said construction.
None appears either on behalf of the municipality or the private respondent.
Affidavit-of-service filed today in Court is taken on record.
As it appears that the order of demolition has been passed by the municipality, accordingly, the
municipality ought to take steps to execute the same in accordance with law.
The municipality is directed to conclude the demolition process of the entire unauthorised construction at the earliest but positively within a period of ten weeks from the date of communication of this order.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
