1. The petitioner prays for correction of his date of birth as stated in the certificate issued by the concerned authority of West Bengal Board of Secondary Education relating to petitioner's participation in Madhyamik Pariksha (Secondary Examination) held in the year 1984.

Learned advocate representing the petitioner submits that inadvertently it is stated in the certificate of Madhyamik Pariksha, 1984 the date of birth of the petitioner is 22nd February, 1966 instead of 21st February, 1970. An application in the prescribed format was made by the petitioner before the Board in May, 2022, but till date same is not decided.

The West Bengal Board of Secondary Education is represented by the learned advocate, who submits based on the birth certificate dated 20th December, 1999, it is difficult for the concerned authority of the Board to take decision taking note of the fact that the petitioner was born on 22nd February, 1966 as recorded in the relevant certificate.

4. Having considered the respective submissions made on behalf of the parties, this Court finds no

useful purpose would be sub-served in keeping this writ petition pending.

5. The President, West Bengal Board of Secondary Education being respondent no. 3 is directed to decide the application of the petitioner dated 12th May, 2022 which is at page 27 of the writ petition, seeking correction of date of birth of the petitioner by six weeks from the date of communication of this order.

6. Before taking such decision respondent no. 3 shall be at liberty to hear the petitioner and the school authority where petitioner studied upto Class - X prior to participating in Madhyamik Pariksha, 1984. The decision to be taken by the respondent no. 3 shall be communicated to the petitioner by fortnight thereafter.

7. The writ petition stands disposed of.

8. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
