Mr. Naba Kumar Das, Mr. Subhabrata Das ... for the State The petitioner is a primary school teacher. She was in leave on account of her health issues. Thereafter she approached the school with a prayer to join and for release of her arrear salary and other dues. The prayer of the petitioner for joining was duly considered and by Office Order dated 15th February, 2022 the petitioner was allowed to join the school with immediate effect.

Learned advocate for the petitioner submits that the petitioner did join the school yesterday i.e. on 23rd February, 2022.

Presently, the prayer of the petitioner is restricted for disbursement of her dues.

It has been submitted that there are several representations which have been given by the petitioner to the respondent authorities praying for

disbursal of her dues but none of them has been considered till date.

The Chairman of the District Primary School Council, Paschim Bardhaman is directed to consider the representation filed by the petitioner on 17th November, 2021 in accordance with law, at the earliest, but positively within a period of twelve weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The petitioner shall be permitted to rely upon all documents in support of her leave to be considered by the aforesaid respondent at the time of consideration of the prayer of the petitioner.

In the event, the aforesaid respondent is of the opinion that the petitioner will be entitled to any financial benefit then necessary consequential steps shall be taken by the said respondent.

The petitioner is directed to forward a copy of her representation dated 17th November, 2021 to the Chairman of the District Primary School Council, Paschim Bardhaman at the time of communicating the order of this Court.

The writ petition stands disposed of.

The Office Order dated 15th February, 2022 allowing the petitioner to join the school be retained with the records.

Affidavit of service filed in court today is taken on record.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
