The petitioner alleges that the private respondent is making an unauthorized and illegal construction. The petitioner raised a grievance before the police authority as well as the municipality. The petitioner complains that his representation has not been considered by the authority till date.

As it appears that the petitioner has already raised his grievances before the municipality and the same has been kept pending for a considerable period of time, the instant writ petition is disposed of by directing the Board of Councillors, Contai Municipality being the respondent No. 6 herein to consider the representation made on behalf of the petitioner through his learned advocate on 2nd January, 2020, strictly in

accordance with law, after giving an opportunity of hearing to the petitioner as well as all other necessary parties, within a period of four months from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order in the matter and communicate the same to the petitioner and all other necessary parties immediately thereafter.

It is made clear, that this court has not gone into the merits of the claim raised by the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner.

The petitioner is directed to forward a copy of the notice demanding justice dated 2nd January, 2021 to the Board of Councillors at the time of communication of a copy of this order.

W.P.A. 1216 of 2020 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
