Mr. Sanat Kumar Biswas Mr. Swapan Kumar Dutta ..for the petitioner Mr. Sirsanya Bandopadhyay Mr. Arka Kumar Nag ..for the State Having heard the learned advocates for the respective parties, this writ petition is disposed of with a direction upon the Officer-in-Charge, Burtolla Police Station to ensure that peace is maintained and the order of status quo passed in Title Suit No. 1119 of 2019 by the learned Judge, 2nd Bench, City Civil Court, Calcutta, is complied with by the parties, if the said order of status quo is still subsisting.

The investigation with regard to the Burtolla Police Station Case No. 172 of 2021 dated October 27, 2021, has ended with the filing of the charge sheet on January 24, 2021 and as such the petitioner does not find that the allegations against the police authorities are correct.

The direction upon the police authorities shall be subject to any decision that shall be taken in the civil suit, on the application filed by the petitioner regarding violation of the order of status quo.

This order shall not be construed as an acceptance of the Court with regard to the allegation of violation of the order of status quo by the respondent no.4 This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
