This is an application for bail in connection with Hingalgunj P.S. Case No. 58 of 2020 dated 27.04.2020 under Sections 20(a)(b)(c) of the Narcotic Drugs and Psychotropic Substances Act at the behest of the petitioner. Although a huge quantity of contraband has been recovered, but the instant application for bail is filed by the petitioner alleging that he being neither the owner of the land nor 'bargadar' recorded in the record of rights maintained by the BL&LRO has been picked up by the BSF personnel on identification of the main player. Our attention has been drawn to the seizure list where the commercial quantity of contraband was shown to have been recovered from the possession of the petitioner.

In view of Section 37 of the N.D.P.S. Act, we do not find that the petitioner has been able to make out a case taking exception thereto. As such, the petitioner's prayer for bail is rejected.

The application for bail, being CRM 889 of 2021, is, thus, dismissed.
