In the instant revision, the accused/petitioner has prayed for expeditious disposal of N. Case No. 27/2018 arising out of Basirhat Police Station Case No. 62/2018 dated 8th February, 2018 under Section 21(c) of the N.D.P.S. Act, 1985.
It is submitted by the petitioner that the petitioner is a young man of 27 years. He is in custody for about three years. Charge has been framed in the year 2018 but till date trial of the case has not been concluded. Therefore, he has prayed on behalf of the petitioner a direction for expeditious disposal of the case by the Learned Special Judge. Learned Public Prosecutor-in-Charge also submits that expeditious disposal of a criminal case is a fundamental right of an accused and in a case where the accused is in custody expeditious disposal is a rule.
In view of such submission made by the Learned Counsels for the parties, I dispose of the instant criminal revision directing the Learned Special Judge, N.D.P.S. Act,
Barasat, North 24-Parganas to dispose of the said case expeditiously and within a period of six months considering the fact that there are in all seven witnesses in the chargesheet and one witness has already been examined. Let a copy of this order be sent to the Learned Special Judge, N.D.P.S. Act through the department for information and compliance.
The petitioner is at liberty to intimate this order to the Learned Trial Judge obtaining a server copy of the same. (Bibek Chaudhuri, J. )
