IN THE HIGH COURT AT CALCUTTA

Item No.4 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 275 of 2023 In the matter of : Tanmoy Das ... Petitioner.

Mr. Kamakshya Prasad Mukhopadhyay ... For the Petitioner. Mr. Arijit Ganguly, Mr. Sanjib Kumar Dan ... For the State.

Memo of evidence submitted by Mr. Arijit Ganguly, learned advocate appearing for the State be kept on record. Learned advocate appearing for the petitioner has prayed for expeditious disposal of Sessions Case No. 267 (05) 2022 in connection with Kaliganj Police Station Case No. 126 of 2021 dated 13.03.2021 under Sections 448/376 of the Indian Penal Code presently pending before the learned Additional District and Sessions Judge, Fast Track Court-4, Krishnagar, Nadia.

The report so filed reflects that already CSW-1 has been examined and dates have been fixed on 06.07.2023 and 07.07.2023 for examination of CSW-2, CSW-3, CSW-4, CSW5, CSW-6 and CSW-7. Having regard to the fact that the Sessions Case was initiated in the year 2022, I am of the view that the manner in which the proceedings are progressing before the sessions court is satisfactory. In case the learned trial court faces any hindrance for non-appearance of any witness, the learned trial court would seek the assistance of Officer-in-Charge of Kaliganj Police Station who would assist in service of

summons/notices and/or any process issued in respect of any witness.

Since the next dates are fixed in the month of July 2023 pursuant to the earlier date being fixed in the month of June 2023, similar schedule be fixed by the learned trial court in each and every month so that trial can be concluded at the earliest.

With the aforesaid observations, the revisional application being CRR 275 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
