The petitioner is an Assistant Teacher of Kanduria High School, District: Murshidabad.

He applied for general transfer under the 'Utsashree Portal' and was recommended for transfer by the West Bengal Central School Service Commission to Dariapur Imampur Barambol High School (H.S.), District : Maldah. The authority of the school where the petitioner was recommended for such transfer refused to allow him to join on the ground that the post in question is under litigation.

Mr. Ghosh Chowdhury, learned counsel for the petitioner, submits that the said litigation has ended in dismissal as the same was not pressed.

Be that as it may, the representation of the petitioner dated April 22, for rerecommendation, appearing at page 43 of the writ petition, is pending before the Chairman, West Bengal Central School Service

Commission, the respondent no. 3 herein. The said respondent, therefore is requested to dispose of the said representation in accordance with law, after giving the petitioner an opportunity of hearing.

WPA 2016 of 2023 is disposed of with the above terms without any order as to costs.
