Versus

The Union of India Mr. Uday Sankar Chattopadhyay Ms. Sadia Parveen Ms. Bidisha Chakraborty Ms. Aishwarya Datta.

...for the petitioner.

Mr. Anirban Mitra.

...for the NCB.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 7 months and there has been no progress in the trial and similarly placed accused persons have been granted bail.

Learned advocate for the NCB submits that the petitioner is having antecedents. There are two cases, one at Hazaribag and another case by the NCB itself, petitioner has been granted liberty so far as those two cases are concerned.

Having regard to the fact that in the present case the recovery is of 30 kgs. of ganja from the joint possession of the petitioner and others and similarly placed accused person has been

granted bail, I am of the view that further detention of the present petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Manuyara Bibi Sekh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum learned Additional District and Sessions Judge, 3rd Court, Howrah. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall report to the Superintendent of Police, Narcotic Control Bureau or any Officer deputed by him once in a fortnight till further orders of this Court.

Learned advocate for the NCB submits that he has been informed verbally regarding the issues which were confronted to the learned advocate and accordingly he has submitted. Today, no report has been submitted by the NCB in this case. Accordingly, CRM(NDPS) 224 of 2026 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
