D/L62 06.02.2025 Rohit ct.no.28 C.R.M. (A) 323 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Taherpur Police Station Case No. 599 of 2024 dated December 3, 2024 under sections 108/3(5) of the Bharatiya Nyaya Sanita, 2023.

And In Re: Supriya Biswas

...Petitioner

Ms. Sananda Bhattacharyya ...for the petitioner Mr. Debabrata Chatterjee Mr. Soumya Basu Roy Chowdhuri ...for the State 1.

Heard learned Advocates for the parties.

2.

Petitioner submits she is the mother of the principal accused who had a romantic relation with the deceased.

Subsequently, deceased committed suicide.

They have been falsely implicated. He prays for anticipatory bail.

3.

Learned Lawyer for the State opposes the prayer for anticipatory bail. He refers to the suicide note. 4.

We have considered the materials on record including the suicide note. Suicide note states petitioner and her daughter had given an impression to the victim that the latter would marry him. Subsequently the marriage did not take place and he committed suicide. Whether failure to comply with a promise to marry would

constitute abetment to suicide requires to be assessed at the appropriate stage of the proceeding.

5.

Custodial interrogation for progress of investigation is not necessary and petitioner may be granted anticipatory bail.

6.

Accordingly, we direct that in the event of arrest, the petitioner viz., Supriya Biswas be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Petitioner shall appear before the jurisdictional court and pray for regular bail within four weeks from date.

7.

The application for anticipatory bail is, thus, disposed of.
