Versus

Sourav Roy Chowdhury & Ors.

sg Ct. 8 The parties are not represented nor any accommodation is prayed for on their behalf. On the earlier occasion i.e. on 20th June, 2022, the parties were also not represented. We have perused the order impugned. We have perused the order dated 18th September, 2014. In a partition suit the parties were directed to maintain status quo in respect of the suit property till 31st October, 2014. It is axiomatic that during the pendency of a partition suit, the parties are not entitled to alter and/or change the nature and character of the suit properties. Moreover, it appears from the case status report that the application for injunction was probably disposed of in the meantime. On such consideration, we do not find any reason to interfere with the ad interim order, which was of limited duration. In view thereof, the appeal stands dismissed. (Siddhartha Roy Chowdhury, J.)
