Petitioners submit they had invested money in the complainant's business in the course of a running transaction. They had repaid the money. Accordingly, they pray for anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record including the statements of witnesses. There was monetary transaction between the parties. Petitioners claim they have refunded the money advanced to them.

Keeping in mind the aforesaid facts, we are of the opinion custodial interrogation is not necessary but the petitioners require to cooperate with investigation.

Accordingly, we direct that in the event of arrest, the petitioners viz., (1) Biswajit Chakraborty and (2) Jayashree Chakraborty be released on bail upon furnishing a bond of Signed By :

Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner no. 1 viz., Biswajit Chakraborty shall meet the Investigating Officer once in a week until further orders. They shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
