13.02.2025 sdas Rejected C.R.M. (A) No. 327 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Chinsurah Police Station Case No. 398 of 2024 dated 16.09.2024 under Sections 103(1)/61(2)/3(5) of the BNS. And In Re : Raman Das ...... petitioner Mr. Priyankar Ganguly Ms. Shalini Bairagi .....for the petitioner Mr. Partha Pratim Das Mr. Debanik Das ..... for the State 1.
Learned Counsel for the petitioner submits victim had died due to natural causes. He prayed for anticipatory bail. 2.
In light of the aforesaid submission further opinion from post mortem doctor was called for.
3.
Report submitted in Court is placed on record. It shows post mortem doctor opined death was due to intrathoracic and intraperitoneal haemorrhage which are ante mortem in nature and in all probability caused by physical assault. Accordingly, death is homicidal.
4.
Statements of witnesses corroborate this opinion and show petitioner and others had assaulted the victim.
5.
Hence, we are not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, prayer for anticipatory bail is rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
