(NDPS) 136 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hili Police Station Case No. 187 of 2022 dated 14.08.2022 under Sections 21(C)/22(C)/23(C)/27A of the Narcotic Drugs and Psychotropic Substances Act.

And In Re : Najma @ Najma Bibi ...... petitioner Mr. Kaushik Chowdhury Ms. Busra Khatoon ....for the petitioner Mr. Rudradipta Nandy Ms. Sonali Das ....for the State Petitioner prays for bail on the ground of period of detention and that there being no nexus between the petitioner and the person arrested with commercial quantity of narcotic. Moreover, no seizure was made from the petitioner. There are call details recording between the petitioner and the person to whom the narcotic was to be delivered. In such circumstances, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant bail to the petitioner.

In such circumstances, prayer for bail of the petitioner is rejected and the application being CRM (NDPS) 136 of 2023 is dismissed.
