And In re: Patasi Das @ Batashi Mondal ......Petitioner Mr. Jannat Ul Firdous .....For the Petitioner Mr. Tanmoy Kumar Ghosh Mrs. Sima Biswas .......For the State Apprehending arrest in connection with Hasnabad Police Station Case No. 464 of 2020 dated 18.07.2020 under sections 498A/304B/302/34 of the Indian Penal Code, the petitioner has filed the present application. The learned advocate for the petitioner submits that the present petitioner happens to be the aunt-in-law and although there are no allegations against her but charge sheet has been submitted in the instant case against the present petitioner. As such, she apprehends that she may be arrested in connection with this case and filed the present application. Mr.

Ghosh, learned advocate appearing for the State opposes the prayer for anticipatory bail and is unable to satisfy this Court regarding the complicity of the present petitioner so far as overt acts are concerned.

sending the petitioner to custody, we are of the opinion that this is a fit case for granting anticipatory bail to the petitioner. Accordingly, we allow this application and direct that in the event of arrest the petitioner, namely, Patasi Das @ Batashi Mondal, shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 . This order of anticipatory bail will remain in force for a period of eight weeks from date, within which the petitioner shall appear/surrender before the jurisdictional Court and pray for regular bail.

The application for anticipatory bail, being CRM No. 915 of 2021, is, thus, disposed of.
