Case No.644 of 2020 dated 05/09/2020 under Sections 363/365 of the Indian Penal Code, 1860 and adding Sections 376 of the Indian Penal Code, 1860, Section 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 9 of Prohibition of Child Marriage Act, 2006 (corresponding to Spl Case No.110 of 2020).

Petitioner seeks anticipatory bail.

Learned Advocate appearing for the petitioner submits that the petitioner is married to the victim. In support of such claim, learned Advocate appearing for the petitioner produces the marriage certificate.

Photocopy of such marriage certificate be kept with the record.

Learned Advocate appearing for the State draws the attention of the Court to the contents in the case diary. Considering the fact that there is a document suggesting marriage between the petitioner and the victim, we grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- with two sureties of like amount each to the

satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall meet the Investigating Officer once a month till the conclusion of the investigation and that the petitioner shall appear before the jurisdictional Court and pray for regular bail within four weeks from date.

The application for anticipatory bail being C.R.M. (A) 578 of 2022 is, thus, disposed of.
