This is an application for expeditious disposal of G.R. case No. 393 of 2022 corresponding to Kalna Police Station Case No. 148 of 2022 dated 18th March, 2022 under Section 498A/406 of the Indian Penal Code presently pending before the learned Additional Chief Judicial Magistrate, Kalna.

On perusal of the averment made in the instant revision and having heard the learned Advocate for the petitioners this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the State. Accordingly, Mrs. Manasi

Roy learned Advocate is requested to assist this Court on behalf of the state. Appointment of Mrs. Manasi Roy learned advocate be regularized by the learned Legal Remembrancer, Government of West Bengal. 3.

It is submitted by the learned advocate for the petitioners that the case was initiated on the basis of a written complaint made by one H.M. Ofelia being the wife of Mosihur Rahaman Mondal herein before the Kalna Police Station on 18th March, 2022 alleging, inter alia, that after her marriage she was subjected to mental and physical torture for dowry by the petitioners. The defacto complainant was married to the son of the petitioners on 13th October, 2019 according to Muslim Rites and Customs. During marriage gold ornaments weighing 12 bhori was given to the husband but they demanded more money. After the birth of a female child out of their wedlock, mental torture upon the defacto complainant increased and demand of money by the accused persons.

The defacto complainant lodged complaint on 18th March, 2022 against the accused persons and they surrendered before the Learned court below on 12th May, 2022 and obtained interim bail. After completion of investigation chargesheet was submitted dated 10th May, 2022 and the learned court below directed the accused persons to take out copy for the next date fixed on 18th May, 2023 for application copy. 4.

Under such circumstances, petitioners being octogenarians aged about 76 years and 65 years have prayed for expeditious disposal of the case.

In view of such circumstances, the instant revision is disposed of directing the trial court to frame charge and conclude the trial as expeditiously as possible within December, 2023. 6.

With the above direction the instant revision is disposed of. (Bibek Chaudhuri, J.)
