The petitioner has come up being aggrieved by non supply by the concerned authorities of the relevant information, which he has sought for under the provisions of Right to information Act, vide the two consecutive applications of the petitioner, dated 24.01.2018 and 08.08.2018 respectively.

As he was not satisfied with the reply given by the information officer, he has preferred appeal to the 1st appellate authority vide letter dated 26.10.2018 which has not been answered till date, by the same. The petitioner is aggrieved that his important and vital right to know the break up of his numbers, obtained in the examination is jeopardized by such blatant inaction on behalf of the respondents. The grievance of the petitioner is justified as in terms of the provisions of the law the appellate authority cannot rightfully sit tight over the appeal against the order of the information officer. In this

particular case, it is found that the prayer of the petitioner dated 26.10.2018 before the 1st appellate authority is still unanswered.

Accordingly, this writ petition is disposed of with the direction on the appellate authority to consider and dispose of the petitioner's prayer vide letter dated 26.10.2018, within the statutory frame of time, commencing from the date of receipt of copy of this order.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
